TERMS AND CONDITIONS OF USE – KYOUTCH (2025 Version)

1. Purpose and Scope

These Terms and Conditions of Use (hereinafter referred to as "T&Cs") govern access to and use of the Kyoutch.com platform, operated by WEBSCRAT SARL (hereinafter "Kyoutch" or "the Platform"), located at La Bardinie, 24300 Nontron, France.

Kyoutch offers:

• Free skill-based games, allowing players to earn virtual points ("Kyous");

• Paid skill-based games with real-money stakes, available only to players residing outside of France and in authorized jurisdictions;

• 100% free raffles, accessible via Kyous, with no financial consideration or entry fee required.

Kyous have no monetary value and can never be exchanged for cash. They are only used to participate in free raffles and are primarily earned through gameplay activities, with no purchase required.

Access to or use of Kyoutch.com implies full acceptance of these T&Cs.

2. Access Conditions

• Minimum age: Registration is restricted to individuals aged 18 or older.

• Location: Paid games are not available to players residing in France. French users only have access to free games and Kyous, which can only be used to enter free raffles organized by Kyoutch.

• Single account: A player may hold only one personal account.

• Accurate information: Players must provide accurate information upon registration and keep it up to date.

• Responsibility: Players must play responsibly.

3. Account Creation and Management

To create an account, users must:

• Choose a username and a secure password;

• Validate their registration via a confirmation email;

• Provide proof of identity (KYC) for access to paid games.

Kyoutch reserves the right to refuse or suspend any registration if the information provided is incomplete, false, or suspicious.

4. Games Offered

• Free games: All players can access free games and earn virtual points ("Kyous"), which can only be exchanged for entries into free raffles.

• Paid games (skill-based): Skill-based games with real-money stakes are strictly prohibited for users residing in France and are only accessible in jurisdictions where such games are permitted.

• Free raffles: Raffles are 100% free to enter via Kyous, which are earned by playing games. No purchase is required to participate.

5. Deposits and Withdrawals

• Deposits can be made via secure payment providers (credit card, PayPal, or other approved PSPs).

• Withdrawals can only be made to a bank account or PayPal account in the player’s name.

• Deposits are limited by default to EUR 150 per week (adjustable upon request).

• Withdrawals exceeding EUR 1,500 require full KYC verification (ID and proof of residence).

6. Fraud and Anti-Money Laundering

• Kyoutch applies strict identity verification (KYC) for all withdrawals or suspected illegal activity.

• Suspicious deposits or withdrawals may be held until verification is complete.

• Kyoutch reserves the right to report any suspicious transaction to the relevant authorities (e.g., TRACFIN in France).

• Funds must originate from a bank account or payment method in the player’s name.

7. Player Responsibilities

• Players are responsible for keeping their username and password confidential.

• Any fraud, cheating, use of bots, or attempts to manipulate results will result in account suspension.

8. Responsible Gaming

Kyoutch encourages responsible gaming. Players can:

• Set deposit limits via their account settings;

• Request temporary or permanent account closure;

• Access external support resources (e.g., Gambling Help Services).

9. Personal Data and GDPR

• Kyoutch collects only the data required to create and manage user accounts (name, email, payment methods).

• Players have the right to access, rectify, delete, or port their data via the contact form.

• Data is retained for the legally required period (up to 5 years for financial data).

10. Cookies and Tracking

11. Kyoutch’s Responsibilities

• Kyoutch does not guarantee the absence of bugs or service interruptions.

• In the event of a major game malfunction, stakes will be refunded.

• Kyoutch cannot be held responsible for any financial losses due to a player’s actions.

12. Account Termination and Closure

• Accounts inactive for 24 months may be closed after email notification.

• Kyoutch may close an account in cases of fraud, suspicious activity, or violation of the T&Cs.

13. Governing Law and Disputes

• These T&Cs are governed by French law.

• In case of a dispute, the player may seek mediation before any legal action.
